Privacy Policy

Whib's Gym Inc. ("Whib's Gym," "we," "us," or "our") operates gyms in Sicamous and Enderby, British Columbia, and the website whibsgym.com (the "Site"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. It applies to the Site, our gyms, and our phone and text messaging (SMS) communications.

Information we collect

Information you give us

When you register for a membership, sign up for a class or personal training, submit feedback, pay an invoice, or contact us, we collect information you provide, such as your name, mailing address, email address, phone number, date of birth, emergency contact details, membership type, signed waivers and agreements, and the details you include in messages or forms. Payment card details entered to pay an invoice are handled by our payment processor and are not stored on this Site.

Information collected automatically

When you visit the Site, we and our service providers may automatically collect technical information such as your IP address, browser and device type, pages viewed, and referring pages, using cookies and similar technologies (see Cookies and analytics).

Gym access information

Registered members receive a key fob or card for door access. We keep records linking the fob to your membership (for example, which fob was issued and your membership status) so we can grant, limit, or end access.

How we use information

• To register you, manage your membership, and provide gym access, classes, and training.
• To process payments and send invoices and receipts.
• To contact you about your membership, classes, schedule changes, gym hours, and account matters by phone, text message, or email.
• To respond to your questions, requests, and feedback.
• To keep our gyms, members, and equipment safe, and to enforce our membership agreement and gym rules.
• To understand how the Site is used and to improve it and our advertising.
• To meet our legal and accounting obligations.

Phone calls and text messages

If you give us your phone number, we may call or text you at that number about your membership, classes, gym access, payments, schedule changes, and replies to your questions. We send text messages only to people who have agreed to receive them (see our SMS Messaging Terms for the program details, message frequency, rates, and how to opt out). You can stop text messages at any time by replying STOP.

Text messages and calls are carried by our communications service provider (Twilio) and your mobile carrier. These providers process your phone number and the content of messages only to deliver them for us. Mobile carriers and their affiliates are not given your information for marketing. Text messaging opt-in data and consent are not shared with third parties or affiliates for their own marketing purposes.

Sharing and disclosure

We do not sell your personal information. We share it only as follows:

• Service providers that help us run our business under our instructions, such as online form hosting (Wufoo), messaging and calling (Twilio), payment processing, website hosting (Microsoft Azure), mapping (Google Maps), and advertising and analytics (Google). They may use the information only to provide services to us.
• Legal and safety reasons, when required by law, a court order, or a lawful request, or to protect the rights, property, or safety of Whib's Gym, our members, or others.
• Business changes, if our business is sold, merged, or reorganized, in which case information may transfer to the new owner under this policy.

Some of our service providers store or process information outside Canada, including in the United States, where it may be accessible to courts and authorities under local laws.

Cookies and analytics

The Site uses a Google tag (Google Ads) that places cookies or similar technologies in your browser to measure advertising performance and visits to the Site. Embedded content (such as Google Maps and Wufoo forms) may also set its own cookies. You can control or delete cookies in your browser settings, and you can manage Google ad personalization at adssettings.google.com. Blocking cookies may affect how parts of the Site work.

Retention and security

We keep personal information only as long as needed for the purposes described above and to meet legal, tax, and record-keeping requirements, and then securely delete or de-identify it. We use reasonable physical, technical, and administrative safeguards to protect your information, but no method of storage or transmission is completely secure.

Your choices and rights

Under British Columbia's Personal Information Protection Act and Canada's Personal Information Protection and Electronic Documents Act, where they apply, you may ask to see the personal information we hold about you, ask us to correct it, or withdraw your consent to our using it (subject to legal and contractual limits; withdrawing consent may mean we can no longer provide some services, such as gym access). You may also:

• Stop text messages by replying STOP to any message, or tell us you do not want calls.
• Unsubscribe from marketing emails using the link in the email.
• Contact us (below) to make a request. We may need to verify your identity before responding.

Children

The Site is not directed to children under 13, and we do not knowingly collect their personal information through it. Memberships for minors must be arranged by a parent or legal guardian, who provides the information and signs the required agreements.

Changes to this policy

We may update this Privacy Policy from time to time. The effective date at the top shows when it was last changed. If we make material changes, we will post the updated policy on the Site.
